01 Our Services
We provide custom website design and development, ongoing hosting, and post-launch edits/maintenance for small businesses. The specific scope of work for your project will be agreed separately (via quote, email, or project brief) before work begins. Any work outside that agreed scope is treated as a change request and may incur additional fees.
02 Fees & Payment
- Project Fee — a one-off fee covering design and build, as quoted before work starts. Payable in full on confirmation that you wish to go ahead. Work begins once payment has been received.
- Hosting Fee — a recurring monthly fee for hosting, covering server costs, uptime monitoring, and basic security updates. This continues until either party cancels per Section 9.
- Edits & Maintenance — changes requested after launch that fall outside your hosting plan's included allowance (if any) are billed on a price-on-application basis, quoted before work begins and invoiced on completion.
- Late payments may result in Services being paused, including taking your website offline, until payment is received.
- All fees are in GBP and exclude VAT unless stated otherwise.
03 Client Responsibilities
To deliver your project on time, we need you to provide content (text, images, logos), feedback, and approvals promptly when requested. Delays on your end may delay the project timeline and are not our responsibility.
04 Revisions
Your project fee includes two rounds of revisions during the build phase. Additional revision rounds, or changes requested after you've approved the final design, are billed per Section 2 (Edits & Maintenance).
05 Website Content & Intellectual Property
- You retain ownership of all content you provide (text, images, logos, trademarks).
- Once your project fee is paid in full, you own the final website design and code we build for you.
- If you wish to transfer your website away from our hosting (e.g. to self-host or move to another provider), you're free to do so at any time. We'll provide all relevant files and documentation needed to migrate the site, provided your account is up to date with any outstanding fees. It's your responsibility to ensure you (or your new provider) can properly host and maintain the site once transferred.
- We retain the right to showcase completed work in our own portfolio, unless you request otherwise in writing.
- Any third-party assets used (stock images, fonts, plugins) remain subject to their own licences, which we'll disclose if relevant.
06 Hosting & Uptime
We aim for high uptime but do not guarantee uninterrupted, timely, secure or error-free service. Hosting depends on third-party infrastructure that we do not own or control.
We are not liable for any website downtime, however caused, or for any loss or damage arising from it — including lost sales, lost revenue, lost profits, lost or corrupted data, wasted expenditure or damage to reputation. This applies however the downtime arises, including failures of our hosting or infrastructure providers, network or DNS problems, scheduled or emergency maintenance, third-party services, and events outside our reasonable control.
This is not a licence for us to be careless: where downtime is something we can influence, we will work to restore service as quickly as we reasonably can, at no cost to you. You can reach us on the details in Section 15.
07 Domain Names
If we register a domain on your behalf, you own that domain, but we may manage renewal as part of your hosting plan unless agreed otherwise. It's your responsibility to ensure renewal fees are paid to avoid losing the domain.
08 Cancellation & Refunds
- You may cancel hosting at any time with 30 days' written notice. No refunds are given for partial months.
- The project fee is non-refundable once work has begun, reflecting time already invested. If you cancel before work starts, the fee paid is refundable minus a 10% administration fee.
- We reserve the right to decline or end a project relationship at our discretion, refunding any fees for work not yet completed.
09 Termination of Hosting
If hosting fees go unpaid for more than 14 days, we reserve the right to suspend the website and, after 30 days of continued non-payment, remove it entirely. We'll always attempt to contact you first.
10 Warranties & Liability
We build websites to a professional standard but make no guarantee of specific business outcomes (traffic, sales, rankings). To the fullest extent permitted by law, our liability for any claim arising from the Services is limited to the total fees paid by you in the 3 months prior to the claim. We are not liable for indirect or consequential losses, or for website downtime, which is dealt with in Section 6.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
11 Third-Party Services
Your website may rely on third-party tools (hosting providers, plugins, payment processors, analytics). We are not responsible for changes, outages, or charges from these third parties, though we'll do our best to keep things running smoothly.
12 Confidentiality
We won't share your business or personal information with third parties except where necessary to deliver the Services (e.g. hosting providers) or as required by law.
13 Changes to These Terms
We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
14 Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
